Booking Terms, Cancellation Policy & Privacy

These terms apply to bookings made directly with Pemberton Discovery Tours Pty Ltd. Bookings made through a travel agent, online travel agent, visitor centre or other third party may also be subject to that provider’s conditions.

Please contact us before booking if you have questions about tour suitability, accessibility, private arrangements or these conditions.

Cancellations and Changes

Please notify Pemberton Discovery Tours as soon as possible by phone or email if you need to cancel or change your booking.

For standard tour bookings:

  • More than 14 days before departure: monies paid will be refunded, less any reasonable administration or third-party costs already incurred.

  • Between 4 and 14 days before departure: a cancellation fee of 20 per cent of the booking value applies.

  • Within 3 days of departure: the full booking amount is payable and no refund is available.

  • Failure to arrive at the designated time and meeting place: no refund is available.

Please arrive at least 10 minutes before departure.

Our guides will wait for a maximum of 10 minutes and will attempt to contact missing guests using the contact details supplied with the booking.

Bibbulmun Track and Munda Biddi Trail transport requests remain pending until reconfirmed closer to the travel date. No driver or vehicle will attend unless Pemberton Discovery Tours has issued final confirmation.

Minimum Numbers

Most scheduled tours require a minimum of four paying guests.

Solo travellers and couples are welcome to book and may join another confirmed departure where seats are available.

If minimum numbers are not reached, we will do our best to:

  • Combine compatible bookings

  • Reschedule guests to another suitable departure

  • Operate with fewer participants where practical

  • Discuss another available option

If it is not possible to operate the tour, Pemberton Discovery Tours may cancel the departure and provide affected guests with a suitable alternative, credit or refund.

Please do not assume that a departure has been cancelled unless we contact you.

Discounts

Some discounts, including concession discounts, may depend on minimum passenger numbers being reached.

Where a discounted departure cannot operate, guests may be offered another confirmed departure where the discount can be retained.

Payments

Payment may be made using the methods displayed during the booking process.

These may include direct deposit, Visa, Mastercard, American Express or other approved payment methods.

A booking is not confirmed until the required payment or authorised card details have been received and booking confirmation has been issued.

Payment on the day may be accepted by prior arrangement, but card details may be required to secure the booking and reserved seats.

Changes Made by Pemberton Discovery Tours

Routes, vehicles, departure times, stops and inclusions may change because of:

  • Weather

  • Track or road conditions

  • Fire danger

  • Flooding

  • National park closures

  • Maintenance

  • Environmental protection requirements

  • Safety concerns

  • Circumstances beyond our reasonable control

If Pemberton Discovery Tours cannot provide the booked tour, we will contact affected guests and offer an appropriate remedy. Depending on the circumstances, this may include an alternative departure, rescheduling, a credit or refund.

Travel Insurance

We strongly recommend suitable travel insurance for domestic and international travellers.

Your policy should cover illness, injury, missed departures, transport delays, cancellations, weather disruption and other unexpected circumstances.

Risks and Participant Responsibilities

Nature-based and 4WD tours involve inherent risks.

These may include:

  • Travel over uneven, sandy or bumpy terrain

  • Vehicle access and steps

  • Changing weather

  • Remote locations

  • Limited mobile reception

  • Delayed access to emergency assistance

  • Uneven natural surfaces

  • Sand, rivers, beaches and coastal conditions

  • Falling branches, wildlife and other natural hazards

By participating, guests acknowledge these risks and agree to follow all reasonable safety directions given by the guide or driver.

Guests must advise Pemberton Discovery Tours of any medical condition, allergy, recent injury, mobility concern or other circumstance that may affect their safe participation or require assistance.

Guests remain responsible for carrying any medication, emergency action plans or personal equipment they may require.

Pemberton Discovery Tours cannot assess a guest’s medical fitness. Guests should obtain advice from their medical practitioner when unsure whether the experience is suitable.

Children and Minors

Children and young people must travel with a parent, legal guardian or responsible adult.

Parents and guardians remain responsible for minors travelling with them and must ensure that they follow the guide’s instructions.

Approved baby capsules, child seats and booster seats may be provided with advance notice. Guests may also request that their own approved restraint be fitted.

Please provide the child’s age and any relevant restraint requirements when booking.

Seatbelts and Vehicle Safety

All passenger seats are fitted with seatbelts.

Seatbelts must be worn whenever the vehicle is moving as a condition of travel.

Guests must not open doors, change seats or move around the vehicle while it is moving.

Alcohol, Drugs and Behaviour

Alcohol consumption is not permitted inside tour vehicles.

Pemberton Discovery Tours may refuse service to any person who appears to be affected by alcohol, illegal drugs or another substance in a way that may compromise safety.

A passenger who behaves dangerously, disruptively, abusively or inappropriately may be removed from the tour at the discretion of the guide or driver.

No refund will be provided where a guest is refused service or removed because of unsafe or inappropriate behaviour.

Personal Belongings

Guests remain responsible for their own phones, cameras, bags, valuables and personal belongings.

Pemberton Discovery Tours does not provide secure storage during standard tours.

Guests should protect equipment from sand, rain, water, sea spray and accidental damage.

Enquiries, Pending Requests and Confirmation

Trail transport requests may be submitted well in advance, but they remain pending until closer to the travel date.

We do not charge for a pending request, and a pending request is not a confirmed booking.

Walkers’ and riders’ plans frequently change during preparation or while travelling. Keeping the request pending allows us to check that:

  • The guest is still completing the walk or ride

  • The travel dates have not changed

  • The pickup and drop-off locations remain correct

  • The transport is still required

  • A suitable driver and vehicle are available

Guests must respond to our confirmation request closer to the travel date.

The transport is only confirmed when:

  • The guest has reconfirmed the final details

  • Pemberton Discovery Tours has accepted the arrangements

  • We have issued confirmation of the transfer

Until that confirmation has been issued, no driver or vehicle will be dispatched and guests must not assume that transport has been arranged.

If the guest does not respond to our confirmation request, the pending request will lapse without charge.

Changes, Cancellations and Failure to Reconfirm

There is no cancellation fee for a transport request that is still pending and has not been confirmed.

If plans change while the request is pending, please let us know so we can close or update the enquiry.

If the guest does not reconfirm the transport when requested:

  • The service will not be confirmed

  • No vehicle or driver will attend

  • The pending request will lapse

  • No charge will apply

Once Pemberton Discovery Tours has issued final confirmation, the agreed transfer arrangements apply.

Please contact us promptly if confirmed pickup details, timing, passenger numbers, luggage or bicycle requirements change. We will advise whether the revised transport can still be accommodated.

National Park Requirements

Many of our experiences operate within national parks and protected natural areas.

Guests must follow all park requirements and guide instructions.

This includes:

  • Remaining within appropriate visitor areas

  • Not feeding wildlife

  • Not collecting plants, fungi, shells, rocks, sand or other natural materials

  • Not bringing dogs or pets into national parks

  • Not carrying firearms or weapons

  • Avoiding damage or disturbance to vegetation, dunes, wildlife and natural features

Registered assistance animals should be discussed with us before booking so that access requirements and park conditions can be checked.

Photography and Drones

Guests are welcome to take photographs for personal use.

Drone use is not guaranteed and must be discussed with the guide before departure.

All drone activity must comply with aviation, park, safety, wildlife and privacy requirements. Drone use must not inconvenience other guests or interfere with emergency services, fire operations, aircraft or park management.

Commercial photography or filming may require additional approvals.

Liability and Australian Consumer Law

To the extent permitted by law, Pemberton Discovery Tours limits its liability for loss, damage or injury arising in connection with its services.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Privacy Policy

Pemberton Discovery Tours Pty Ltd respects your privacy and takes reasonable steps to protect the personal information entrusted to us.

This policy explains how we collect, use, store and disclose personal information when you make an enquiry, book an experience, visit our website, use our online chat, subscribe to communications or otherwise interact with us.

  • Child-restraint requirements

  • From another person booking on your behalf

  • Through our website, online chat, email, telephone or social media

  • Through Rezdy or another booking platform

  • Through a travel agent, online travel agent, visitor centre or distribution partner

  • Through payment processors and service providers used to complete a booking

If you provide personal information about another participant, you should have their permission to do so.

How We Use Personal Information

We may use personal information to:

  • Process and manage bookings and payments

  • Confirm tour details and send pre-departure information

  • Provide tours, transfers, private experiences and related services

  • Arrange seating, child restraints, dietary requirements or accessibility support

  • Respond to enquiries

  • Contact guests about delays, minimum numbers, changes, emergencies or cancellations

  • Maintain operational, accounting, safety and insurance records

  • Improve our services and website

  • Meet legal, licensing, insurance, taxation and regulatory requirements

  • Send newsletters or marketing information where consent has been provided or where permitted by law

You may unsubscribe from marketing communications at any time using the unsubscribe link provided or by contacting us.

Sensitive Information

Health, disability, allergy and other sensitive information should only be provided where relevant to participation, safety or service requirements.

We use this information only for the purpose for which it was provided, unless another use is authorised or required by law.

Guests remain responsible for carrying their own medication, emergency action plans and essential medical equipment.

Booking and Payment Providers

Bookings and payments may be processed through Rezdy, payment gateways, banks, online travel agents or other third-party providers.

These organisations may collect, store or process information under their own privacy policies and security practices.

Pemberton Discovery Tours does not intentionally store complete credit-card numbers in its general business records. Payment information is handled through authorised booking and payment systems.

Please refer to the relevant booking or payment provider’s privacy policy for details about how its systems handle payment information.

Disclosure of Information

Relevant personal information may be disclosed to:

  • Guides, drivers, employees and contractors involved in providing the service

  • Booking platforms and payment processors

  • Travel agents, online travel agents and visitor centres involved in the booking

  • Technology, website, email, accounting and customer-management providers

  • Insurers and professional advisers

  • Emergency services or medical personnel when reasonably necessary

  • Government agencies where required or authorised by law

We do not sell personal information to advertisers or unrelated third parties.

Some service providers may store or process information outside Australia. Their handling of information is subject to their own systems, contracts and privacy obligations.

Website, Cookies and Online Chat

Our website and connected services may use cookies, analytics tools, chat technology and similar services to operate the website, understand visitor activity and improve the customer experience.

Our website chat may use artificial intelligence to answer general questions. AI responses may contain errors and should not be relied upon for final booking, safety, accessibility, medical or timing decisions.

Information entered into the chat may be stored within Wix or another connected service and made available to our team for customer service and follow-up.

Please do not provide unnecessary financial, identification or highly sensitive medical information through website chat.

Photographs and Video

Photographs or video may be taken during tours for guest sharing, website content, social media and marketing.

Where practical, we will advise guests when identifiable marketing images are being taken.

Please tell your guide if you or a child travelling with you do not wish to be photographed or recorded.

We will respect reasonable requests not to use identifiable images. Parents and guardians are responsible for advising us regarding children in their care.

Security and Retention

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

Measures may include password protection, controlled access, reputable booking and payment systems, secure devices and appropriate record-management practices.

No internet transmission or storage system can be guaranteed to be completely secure.

We retain information only for as long as reasonably required for bookings, customer service, insurance, accounting, taxation, legal and operational purposes.

Information that is no longer required may be securely deleted, de-identified or archived as permitted by law.

Access and Correction

You may ask to access or correct personal information we hold about you.

We may need to verify your identity before providing access or making changes.
